End User License Agreement

Copyright © 2026 Radomil Kmenta.

This agreement is between you and Radomil Kmenta ("the author"). It covers Overtoaster: the Mac app, the Windows host, the shared core, their source code, documentation and artwork ("the Software"). By installing, building or using the Software you accept this agreement. If you do not accept it, do not install, build or use the Software.

1. Licence

1.1 One licence is for one person. With a licence you may install and use the Software on any number of Macs and PCs that you own or control, for your own use.

1.2 Without a licence you may use the Software only during a trial period, if the author offers one, and only for evaluating it.

1.3 The Software is licensed, not sold. The author keeps all rights not expressly granted here, including copyright and all other intellectual property in the Software.

2. Source Code

2.1 The source code is published so you can read it, learn from it, check what it does and fix problems for yourself.

2.2 You may download, read and modify the source code and build it for your own personal use on your own computers.

2.3 You may send changes (patches, pull requests) to the author. By sending them you grant the author a perpetual, worldwide, royalty-free, irrevocable licence to use, change and distribute them as part of the Software under any terms, and you confirm that you have the right to grant it.

3. Restrictions

You may not, except where the law allows it despite this agreement:

a. distribute, sell, rent, lend, sublicense or publish the Software, its source code, builds of it (modified or not) or any part of them, for free or for money; b. share your licence or licence key with anyone else; c. remove or work around licence checks, trial limits or copyright notices; d. use the source code, or any part of it, in another product or service; e. offer the Software, or access to it, as a hosted or paid service to others.

4. Third-Party Components

The Software includes and uses components by others under their own licences (listed in THIRD_PARTY_NOTICES.md). Those licences apply to those components, and nothing in this agreement limits the rights they give you.

5. Updates

A licence includes the updates the author releases for the same major version (for example all 1.x versions). A new major version may need a new or upgraded licence.

6. No Warranty

The Software is provided "as is", without warranty of any kind, express or implied, including fitness for a particular purpose and non-infringement. The Software changes settings on your computers (displays, sound devices, power, input) to stream them; you use it at your own risk.

7. Limitation Of Liability

To the extent the law allows, the author is not liable for any indirect, incidental, special or consequential damage, or for lost data, profits or use, arising from the Software, even if told of the possibility. The author's total liability is limited to the price you paid for your licence. Nothing here limits liability that cannot be limited by law, or your rights as a consumer under the law of your country.

8. Termination

This agreement ends automatically if you break it. You must then stop using the Software and delete all copies of it and of its source code.

9. Governing Law

This agreement is governed by the law of the Czech Republic. Courts of the Czech Republic decide disputes, unless the consumer law of your country gives you the right to go to your own courts.
